1. What DeliveryFor Is
DeliveryFor is a technology platform that connects people and businesses who need local cargo delivery ("Customers") with independent drivers who own suitable vehicles ("Drivers"). DeliveryFor does not itself transport goods and is not a motor carrier or freight broker. Drivers are independent contractors, not employees or agents of DeliveryFor.
2. Eligibility & Accounts
- You must be at least 18 years old and able to form a binding contract.
- You must give accurate information, verify your email address, and keep your details up to date.
- You are responsible for everything that happens under your account. Keep your password secure and tell us right away about any unauthorized use.
- One person or business per account. Accounts may not be sold or transferred.
3. Placing Orders (Customers)
- When you request a delivery, you describe the items (type, quantity, approximate weight and size), pickup and drop-off locations, timing (ASAP or scheduled), and vehicle or equipment needs.
- Orders are subject to Driver availability and our service area. We cannot guarantee that a Driver will accept any particular order or arrive at a specific time.
- Prices shown before you submit are estimates based on the information you provide. If the actual load, distance, wait time, or access conditions are materially different, the price may be adjusted or the Driver may decline the job.
4. Pricing, Payments & Tips
- Prices are based on distance, vehicle type, load, urgency, and any equipment add-ons, plus a service fee. The full breakdown is shown before you confirm.
- Payments are processed by Stripe. When you place an order, we place an authorization hold on your payment method; the charge is captured after the delivery is completed.
- You authorize us (through Stripe) to charge your selected payment method for the order total, any approved adjustments, tips, and applicable fees.
- Tips are optional. 100% of tips go to the Driver.
- Receipts are available in the app.
5. Cancellations & Refunds
- Before pickup: you may cancel at no charge, and any authorization hold is released. [If you add a late-cancellation fee once a Driver is en route, state it here.]
- Once a Driver is en route or after pickup: cancellation is handled through support (in-app chat with your Driver or support@deliveryfor.com). You may be responsible for charges already incurred, including return of the items.
- Refunds for problems with a completed delivery are reviewed case by case through in-app support. Approved refunds are returned to the original payment method, usually within 5–10 business days depending on your bank.
- Drivers may cancel a job if the pickup is unsafe, the load is materially different from what was described, contains prohibited items, or the Customer cannot be reached after a reasonable wait.
6. Prohibited Items
You may not use DeliveryFor to transport:
- Illegal goods, controlled substances, or stolen property
- Hazardous materials regulated for transport (explosives, flammable gases or liquids in commercial quantities, corrosives, toxic or radioactive materials)
- Firearms, ammunition, or weapons
- People or live animals
- Cash, securities, precious metals, or items whose value exceeds [$X] without prior written approval
- Anything that exceeds the safe or legal capacity of the requested vehicle
Drivers may refuse any item they believe is prohibited, unsafe, or not as described.
7. Customer Responsibilities
- Describe items accurately, including weight and dimensions.
- Make sure items are ready, reasonably packaged or bundled, and accessible at the pickup time.
- Make sure there is safe, legal access at pickup and drop-off, and arrange any help needed for loading and unloading unless you booked that service.
- Have the legal right to send the items, and make sure someone is available, or safe drop-off instructions are given, at delivery.
8. Driver Terms
Independent contractor relationship
- Drivers are independent contractors. You decide when to go online, which jobs to accept or decline, and how to perform them, subject to these Terms and applicable law. There are no minimum hours.
- You are responsible for your own vehicle, fuel, maintenance, tools, equipment, phone, data plan, taxes, and business expenses.
Requirements
- Hold a valid driver's license and any license or endorsement required for your vehicle and load.
- Keep valid vehicle registration and insurance that meets your state's minimum requirements and covers commercial or delivery use. Personal auto policies may not cover deliveries; check with your insurer.
- Upload current documents (license, insurance, registration, vehicle photo) and keep them up to date. Expired documents may block you from going online.
- Obey all traffic, load-securement, weight, and safety laws. Never use the app in a way that distracts you while driving.
Earnings & payouts
- Each job shows its pay before you accept. Drivers currently receive 80% of the delivery fee plus 100% of tips. We may change this split with notice, and changes will not affect jobs you have already accepted.
- Payouts go through Stripe Connect. You must complete Stripe's onboarding and identity verification to get paid and agree to the Stripe Connected Account Agreement.
- Earnings are released after the delivery is completed and the customer payment is captured. Earnings may be held or reversed for fraud, chargebacks, or deliveries that were not actually completed.
- You are responsible for reporting and paying your own taxes. We may issue tax forms (e.g., 1099) as required by law.
Delivery standards
- Share your location while online and on an active job so customers can track their delivery.
- Handle items with reasonable care and secure loads properly.
- Capture proof of delivery (photo and/or signature) at drop-off.
- Don't cancel after pickup without the Customer's agreement, except in an emergency or safety situation.
9. Conduct, Ratings & Chat
- Treat everyone with respect. Harassment, discrimination, threats, or violence will get your account removed.
- Use in-app chat only for delivery-related communication. Do not share chat content or another user's contact details outside the platform.
- Do not arrange deliveries off-platform with people you meet through DeliveryFor or try to avoid platform payments.
- Ratings and reviews must be honest and based on the actual delivery.
- Do not interfere with, reverse-engineer, scrape, or misuse the Services or create fake accounts or orders.
10. Damage, Loss & Claims
- Report damaged, missing, or incorrect deliveries through the app within [48 hours] of delivery, with photos where possible.
- Claims are reviewed using order details, chat history, location data, and proof-of-delivery photos.
- Unless otherwise required by law, any recovery for loss or damage is limited to the lesser of the item's actual cash value or [$X per order], and only where the loss was caused by the Driver's negligence while the item was in the Driver's care. Items that were improperly packaged, misdescribed, or prohibited are not covered.
11. Disclaimers & Limitation of Liability
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, DELIVERYFOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THE QUALITY, SUITABILITY, SAFETY, OR ABILITY OF ANY DRIVER OR CUSTOMER.
TO THE FULLEST EXTENT PERMITTED BY LAW, DELIVERYFOR WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID OR EARNED THROUGH DELIVERYFOR FOR THE ORDER GIVING RISE TO THE CLAIM, OR (B) $100. Some jurisdictions do not allow these limitations, so they may not fully apply to you.
You agree to indemnify DeliveryFor against claims that arise from your misuse of the Services, your items, or your violation of these Terms or the law.
12. Suspension & Termination
You can delete your account at any time from the app (Profile → Delete Account) or by emailing support@deliveryfor.com. We may suspend or end your access if you break these Terms, create risk for other users, or as required by law. Sections that by their nature should survive (payments owed, liability limits, disputes) survive termination.
13. Our App & Content
DeliveryFor and its logos, software, and content are owned by us or our licensors. We grant you a limited, revocable, non-transferable license to use the apps for their intended purpose. You keep ownership of content you submit (photos, messages, reviews) and give us a license to use it to operate and improve the Services.
14. Disputes & Governing Law
These Terms are governed by the laws of the State of [State], without regard to conflict-of-law rules. Before filing a claim, you agree to contact us at support@deliveryfor.com and try to resolve it informally for 30 days. [Counsel: insert arbitration / class-action waiver or venue clause here.]
15. Changes & Contact
We may update these Terms. We will notify you in the app or by email of material changes, and the "Last updated" date will change. Continuing to use the Services after an update means you accept it.
